Terms of Service: PDF Census

These terms are an agreement between you (the organization ordering the service, "you") and PDF Census, an Arizona sole proprietorship ("PDF Census", "we", "us"). Contact: apolyre@pdfcensus.com. Our owner's legal name and mailing address are available to customers on request.

1. What we provide

PDF Census is an automated inventory and triage of the PDF files publicly linked from a website you name ("Your Site"). For each order we:

  • crawl the public, unauthenticated pages of Your Site, following robots.txt and a rate limit of no more than 2 requests per second;
  • run automated checks on each PDF we find (tagging, document language, document title, presence of a text layer, form fields, page count, and dates);
  • sort each PDF into categories using published rules, and estimate remediation cost from per-page rates; and
  • deliver a report as a spreadsheet and a printable web page ("the Report").

The Triage Report is a one-time deliverable. The Quarterly Re-scan is a subscription that repeats the scan each quarter and reports new and changed PDFs.

2. What we do not provide

  • No legal advice. We are not a law firm and the Report is not legal advice. Labels such as "Review With Counsel" or "Archive Candidate" are prompts for your attorney, not conclusions about whether a document is covered by any exception under 28 C.F.R. Part 35 or any other law. Exception flags are for your counsel to decide.
  • No conformance determination or certification. Automated checks cannot confirm WCAG conformance. A PDF in "Passes Automated Checks" may still fail WCAG 2.1 AA. We do not certify, guarantee or represent that any document, website or organization meets the ADA, Section 504, Section 508, WCAG or any state law.
  • No remediation. We do not fix, edit, host or remove documents.
  • Estimates are estimates. Cost estimates use generic per-page rates and are not quotes from any vendor.

3. Your responsibilities

You confirm that you are authorized to order a scan of Your Site, or that Your Site is publicly available and you are ordering on behalf of the organization that operates it. You will give us an accurate website address and a working contact email.

4. Orders and delivery

We aim to deliver the Report within 3 business days (Monday to Friday, excluding US federal holidays, Arizona time) after we receive payment or a valid purchase order. If Your Site blocks our crawler, requires a login, or is unavailable, we will tell you and you may choose a full refund or a new delivery date.

Tier limits: the $490 tier covers up to 2,000 PDFs; the $990 tier covers more than 2,000 PDFs, up to 10,000. If a $490 order turns out to have more than 2,000 PDFs, we will ask before delivering whether you want to upgrade or receive the first 2,000 found. Before we start any scan we check the size of Your Site. If it hosts more than 10,000 PDFs, we will send you a quote for the larger scope before doing the work; if you do not accept it, we refund your payment in full.

Pays-for-itself guarantee: if a delivered Triage Report shows less avoidable remediation than the price you paid (its "fix everything" low estimate minus its "fix first" low estimate), you may ask for a full refund within 30 days of delivery. Free re-scan bonus: within 6 months of delivery, we re-scan the files on your Fix First list once at no charge when you ask.

If we cannot complete an order for any reason, including the reasons above, our sole obligation and your exclusive remedy is a full refund of the amount you paid for that order.

5. Prices, payment and taxes

Prices are in US dollars and shown on our website at the time of order. Card payments are processed by Stripe. We also accept purchase orders and invoices, payable net 30 by check or ACH. You are responsible for any taxes that apply to your purchase, except taxes on our income; if you are tax-exempt, send us your exemption documentation.

6. Quarterly Re-scan subscription

The Re-scan renews every three months at the price shown when you subscribed until you cancel. You can cancel at any time by emailing us; cancellation stops future renewals and we do not charge again. See our Refund Policy for partial quarters.

7. Confidentiality and data

We treat Your Report as confidential. We do not publish it or name you as a customer without your written permission. Our sample report is built from a scan whose entity name and web addresses are removed. See our Privacy Policy for how we handle data.

8. Warranty disclaimer

The Report is provided "as is". Apart from what these terms expressly say, we disclaim all warranties to the extent the law allows, including merchantability, fitness for a particular purpose, and that the Report is complete or error-free. Websites change and some PDFs may not be linked, reachable or readable at scan time.

9. Limitation of liability

To the extent the law allows, our total liability for any claim relating to an order is limited to the amount you paid for that order (or, for the Re-scan, the last quarter's fee). Neither party is liable for indirect, special or consequential damages.

10. Government customers

If you are a public entity:

  • Where your purchase order terms, a state statute or your procurement rules conflict with these terms, the conflicting provision of these terms does not apply to the extent required by that law.
  • Arizona public entities may cancel under A.R.S. ยง 38-511 (conflict of interest), which applies by law. Obligations beyond the current fiscal year are subject to appropriation.
  • We will provide a W-9 and a written quote on request.

11. Governing law

These terms are governed by the laws of the State of Arizona.

12. Changes

We may update these terms. Changes do not affect an order already placed. The date at the top shows the latest version.
